讲座背景 Background：

近年来，中国对民营企业、外资企业的政策法规环境持续优化完善。国家在立法层面始终秉持一个明确方向——将对民营企业、外资企业的平等保护落到实处，为各类经营主体营造更加稳定、公平、可预期的营商环境。基于这一背景，我们聚焦外资企业合规风险防范这一主题，围绕三个核心议题展开讲座。

In recent years, China has continued to optimize and refine its policy and regulatory environment for private enterprises and foreign-invested enterprises. At the legislative level, the state has consistently upheld a clear direction—to implement equal protection for private enterprises and foreign-invested enterprises in earnest, and to foster a more stable, fair, and predictable business environment for all types of market entities. Against this backdrop, we have chosen to focus on the theme of compliance risk prevention for foreign-invested enterprises, and will conduct this seminar around three core topics.

内容大纲 Content Outline：

（1）2026年《司法解释（二》的核心解读 Core Interpretation of the 2026 Judicial Interpretation (II)

新规出台后，民营企业和外资企业的财产也能像国有企业一样受到刑法同等保护。对企业而言，这是实实在在的利好：资产更安全了，法律撑腰的底气更足了。

Following the promulgation of the new regulation, the assets of private enterprises and foreign-invested enterprises, like those of state-owned enterprises, are now afforded equal protection under criminal law. For businesses, this is a tangible benefit: greater asset security and stronger legal backing to stand on firm ground.

（2）刑事诉讼三阶段风险防范Risk Prevention Across the Three Stages of Criminal Proceedings

2025年5月20日，《民营经济促进法》正式施行；2025年3月，公安部发布了《公安机关跨省涉企犯罪案件管辖规定》。企业面临司法机关违法插手经济纠纷、错误刑事执法时，如何有效地在侦查、审查起诉、审判三个阶段进行有效应对、如何防范风险。

On May 20, 2025, the Private Economy Promotion Law officially came into effect; in March 2025, the Ministry of Public Security issued the Provisions on Jurisdiction over Cross-Provincial Enterprise-Related Criminal Cases Handled by Public Security Organs. When enterprises face unlawful interference by judicial authorities in economic disputes or erroneous criminal law enforcement, how can they effectively respond and mitigate risks during the three stages—investigation, review and prosecution, and trial?

（3）知识产权合规风险防范 Intellectual Property Compliance Risk Prevention

商标被抢注了怎么办？怎么提前做好布局、防止被钻空子？被侵权之后怎么处理？

What should you do if your trademark is preemptively registered by others? How can you plan ahead to prevent loopholes from being exploited? And how should you respond after an infringement occurs?
